Tax Grievances – Top 5 Questions

Top five most frequently asked questions about the grievance process:

It’s that time of year. I’m busy preparing my client’s cases to be filed with the various Boards of Assessment Review. As you may suspect, many questions are asked of me in regard to the grievance process. The following are the five most frequently asked:

Is the deadline June 1st?
No; All Westchester towns and cities (except White Plains and Yonkers) have a grievance window that opens on June 1st and closes on the third Tuesday in June (grievance day). This year grievance day is June 19th.

My buyer is in contract but won’t close until after grievance day. Do they have to wait a year to file?
No; Contract Vendees have the same right to challenge the assessment as the owner.

Can the Board of Assessment Review increase an assessment?
The Board can either decrease or deny; They have no right to increase an assessment.

Is the Board of Assessment Review limited to a maximum 25% reduction?
No; The Board has the right to grant any reduction they feel is warranted. The second stage of the process; known as Small Claims Assessment Review (SCAR) is usually limited to 25% above any reduction the board may have granted. (SCAR is limited to owner-occupied one, two or three family homes).

Can any property owner file a grievance?
Yes; There are no limitations as to who may file a grievance. Any property owner who is dissatisfied with the Board’s decision, may file an article 7 petition (tax certiorari) if they are not eligible for SCAR.
